Terms of Service

These Terms of Service (the “Terms”) set forth the terms and conditions governing the use of the online store and website operated by Ensin Co., Ltd. (the “Company,” “we,” “us,” or “our”) under the name “Chronure” (collectively, the “Services”).

The Services are provided using the Shopify platform.

By browsing or using the Services, or by purchasing products through the Services, you agree to be bound by these Terms and our Privacy Policy.

Article 1 – Application

These Terms apply to your use of the Services and to all transactions, including the sale and purchase of products, between you and the Company in connection with the Services.

Our Refund Policy, Shipping Policy, Privacy Policy, and other policies posted on the Services form part of these Terms.

If there is any inconsistency between these Terms and any individual policy, the individual policy shall prevail with respect to the relevant matter, unless otherwise specified.

Article 2 – Accounts and Customer Information

When using the Services, you may be required to provide certain information, including your email address, name, address, telephone number, billing information, and shipping information.

You are responsible for ensuring that all information provided to us is accurate and up to date.

If you create an account, you are responsible for maintaining the security of your login credentials and may not transfer, lend, or otherwise permit unauthorized use of your account by any third party.

Article 3 – Products

We primarily sell pre-owned and vintage items, including watches, jewelry, accessories, and branded goods.

Due to the nature of pre-owned and vintage products, items may exhibit signs of age and use, including scratches, scuffs, discoloration, deterioration, repair history, or replacement parts. We make reasonable efforts to describe the condition of each product through photographs and descriptions on the relevant product page.

Colors, textures, and other aspects of a product's appearance may differ from the actual product depending on your device, display, browser, and other viewing conditions.

If you have any questions regarding the condition of a product, please contact us before making your purchase.

If we discover any errors in a product description, price, or other product information, we may correct such information as necessary.

Article 4 – Watches

Pre-owned and vintage watches may have been manufactured many years ago and are therefore not guaranteed to provide the same accuracy, durability, or other performance characteristics as modern products.

The accuracy of mechanical watches may vary depending on position, operating environment, temperature, magnetism, winding condition, and other factors.

Unless expressly stated otherwise in the product description, water resistance is not guaranteed for pre-owned or vintage watches.

Products supplied with a repair warranty are subject to our separate warranty terms and conditions.

Article 5 – Orders and Formation of Contract

An order placed by a customer constitutes an offer to purchase a product from the Company.

A sales contract is formed when the Company confirms the order and payment status and accepts the order.

To the extent permitted by applicable law, we may cancel an order or terminate a sales contract, including after an order has been accepted, in any of the following circumstances:

• The product is no longer available.
• The product has been sold through our physical store or another sales channel before inventory records have been updated.
• There is a material error in the product price, description, or other product information.
• Payment cannot be successfully processed.
• We reasonably suspect fraudulent use or a fraudulent order.
• Other reasonable circumstances make fulfillment of the order impracticable.

If payment has already been received in such circumstances, we will issue a refund using our prescribed method.

Article 6 – Prices

Prices for sales within Japan are generally displayed inclusive of applicable consumption tax.

For international orders, customs duties, import taxes, import consumption taxes, customs clearance fees, and other charges may apply depending on the destination and other circumstances.

Unless expressly stated otherwise by us, such charges are the responsibility of the purchaser.

Product prices may be changed without prior notice. However, changes made after a sales contract has been formed will not affect the price applicable to that contract.

Article 7 – Payment Methods

Available payment methods are those displayed during checkout.

Payment methods may include:

• Shop Pay
• Apple Pay
• Google Pay
• PayPal
• Bank Transfer

When using a third-party payment service, the terms and conditions of the relevant payment service provider may also apply.

Any bank transfer fees shall be borne by the customer.

Article 8 – Shipping and Delivery

Shipping within Japan is free of charge unless otherwise specified by us.

International shipping fees vary depending on the destination country or region, package size, weight, and other relevant factors.

Estimated delivery times after shipment are as follows:

Within Japan: approximately 1–3 days
International: approximately 3–14 business days

These delivery times are estimates only. Delivery may be delayed due to circumstances beyond our reasonable control, including carrier delays, weather conditions, natural disasters, traffic conditions, and customs procedures.

Article 9 – Returns and Exchanges

Due to the nature of pre-owned and vintage products, returns or exchanges for reasons attributable to the customer, including a change of mind, differences in perceived appearance, or issues relating to size or fit, are generally not accepted.

If the product has a significant defect or issue that clearly differs from the product description, please contact us within two days of delivery, including the date of delivery.

Eligibility for returns, return procedures, return shipping costs, refund methods, and other details are governed by our Refund Policy.

Refund Policy

Please note that the cooling-off system applicable to certain types of transactions in Japan does not generally apply to online mail-order sales. Any applicable return conditions are governed by our stated return policy and applicable law.

Article 10 – Product Warranty

For eligible watches, we provide a six-month repair warranty from the date of purchase.

The warranty generally covers qualifying mechanical failures that occur during normal use within Japan.

The following are generally excluded from warranty coverage:

• Failure or damage caused by dropping, impact, or other external forces
• Failure or damage caused by water exposure, water ingress, moisture, or humidity
• Magnetization
• Failure or damage caused by misuse or improper handling
• Scratches, wear, deterioration, or damage to external components, including the case, bracelet, strap, crystal, dial, hands, and crown
• Failure resulting from repair, disassembly, modification, or other work performed by a third party
• Other conditions that cannot reasonably be considered mechanical failures arising from normal use

Warranty eligibility will be determined after inspection of the product and assessment of the cause of the failure.

Nothing in this Article is intended to improperly restrict any rights available to customers under applicable law.

Article 11 – Intellectual Property Rights

All copyrights, trademarks, and other intellectual property rights relating to text, photographs, images, videos, logos, designs, and other content displayed through the Services belong to the Company or to the relevant third-party rights holders.

Except where permitted by applicable law, including for private use, you may not reproduce, republish, modify, distribute, publicly transmit, sell, or otherwise use such content without our prior permission.

Article 12 – Third-Party Services

The Services may use payment, shipping, application, and other services provided by Shopify and other third parties.

The terms of service, privacy policies, and other rules of the relevant third-party service providers may apply to your use of such services.

Article 13 – Third-Party Links

The Services may contain links to websites and services operated by third parties.

We do not guarantee the content, accuracy, security, or other aspects of third-party websites or services that are not directly controlled by us.

Article 14 – Relationship with Shopify

The Services are provided using the Shopify platform.

However, unless otherwise expressly stated, sales contracts for products offered through the Services are entered into directly between you and the Company. Shopify is not the seller of the products offered through the Services.

Article 15 – Personal Information

We handle customers' personal information in accordance with our Privacy Policy and applicable laws and regulations.

Privacy Policy

Because the Services use Shopify, Shopify and other service providers may process information to the extent necessary to provide the Services.

Article 16 – Prohibited Conduct

When using the Services, you must not engage in any of the following:

• Conduct that violates applicable laws or public order and morals
• Conduct related to criminal activity
• Infringement of intellectual property rights or other rights of the Company or any third party
• Provision of false or inaccurate information
• Impersonation of another person
• Interference with the operation of the Services
• Unauthorized access to the Services
• Transmission of viruses or other harmful programs
• Conduct that causes disadvantage, damage, or unreasonable inconvenience to the Company or any third party
• Any other conduct that the Company reasonably determines to be inappropriate

If we determine that a customer has violated this Article, we may take appropriate measures, including restricting access to the Services or canceling orders.

Article 17 – Accuracy of Information

We make reasonable efforts to ensure that product descriptions, prices, inventory information, shipping information, and other information provided through the Services are accurate.

However, such information may occasionally differ from the actual circumstances due to typographical errors, display issues, delays in updating information, or other reasons.

If an error is discovered, we will make reasonable efforts to correct it promptly.

Article 18 – Changes or Suspension of Services

We may change, suspend, or discontinue all or part of the Services when reasonably necessary due to system maintenance, technical failures, natural disasters, or other circumstances.

Article 19 – Disclaimer and Liability

We shall not be liable for delays in delivery, communication failures, system failures, failures of third-party services, or other damages arising from circumstances beyond our reasonable control, except where such damages result from our intentional misconduct or negligence.

Our liability for damages arising from breach of contract, tort, or otherwise shall be governed by the Civil Code of Japan, the Consumer Contract Act of Japan, and other applicable laws and regulations.

Nothing in these Terms excludes or limits liability for damages resulting from the intentional misconduct or gross negligence of the Company, its representatives, or employees where such exclusion or limitation is prohibited by applicable law.

Article 20 – Measures in the Event of Violation

If a customer violates these Terms, engages in fraudulent activity, or otherwise creates a material issue affecting the operation of the Services, we may take appropriate measures to the extent reasonably necessary, including suspending access to the Services or the customer's account.

Article 21 – Severability

If any provision of these Terms is determined to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.

Article 22 – Changes to These Terms

We may amend these Terms when necessary due to changes in applicable laws, changes to the Services, or other reasonable circumstances, in accordance with applicable law.

Any amended Terms will be announced by posting them on the Services or by another appropriate method.

Article 23 – Governing Law and Jurisdiction

These Terms and any contracts relating to the Services shall be governed by and construed in accordance with the laws of Japan.

Unless otherwise required by applicable law, any dispute arising between you and the Company in connection with the Services or these Terms shall be subject to the jurisdiction of the competent court in Japan having jurisdiction over the location of the Company as the agreed court of first instance.
